By using Carib Gourmet, you agree and are bound to the following policies, conditions and privacy statement as well as those we might notify in the future which constitute the agreement between the parties, you as the customer, us as the online retailer. This does not affect your statutory rights as a consumer or as a company. The online shopping terms and conditions apply to all types of orders you might place on our website, Carib Gourmet (www.carib-gourmet.com). Read them carefully before placing an order and feel free to print a copy for your reference.
To place an order with Carib Gourmet, you have to register. Your username and password are your responsibility to be maintained confidential. You are also responsible for all activities occurring under your account or password. If you have reasons to believe that your username/password are known by anyone else or will be used in a malicious manner, please inform us.
The details provided when registering must be correct and complete. Also ensure that we are updated with any changes to your details. We reserve the right to refuse access to the Website, terminate accounts, remove or edit content, or cancel orders at our discretion. You will not incur any charges if we cancel an order.

When using Carib Gourmet, your personal details and some transactional are needed. We only use these information to process your orders and will never pass them on to third parties for marketing purposes. With you permission, we might send you information on offers we think my interest you.
To fulfil your orders we send you emails and by using Carib Gourmet, you agree to receiving communication from us.
When placing your order we ask that you provide details which are true, accurate, current and complete and that the credit or debit card details are correct and your own.

Purchase on Carib Gourmet is reserved to adults only (over 18). Those under 18 must use the website under the supervision of a parent or guardian.
By law we cannot sell knives, products containing alcohol or products containing tobacco to persons under the age of 18. Therefore by ordering from Carib Gourmet you confirm that you are of legal age. It is illegal to buy restricted products if you are not of legal age or for someone who is under age. We may request a proof of ID.
When you place an order for an alcoholic product, you confirm that you are aged 18 or over.
Product specifications and description
We have made every effort to outline the colours, specifications, dimensions and description of items on the website as accurately as possible. The images of the products you see on the screen depend on your monitor and cannot guarantee it will accurately reflect the item delivered.
Content & Intellectual Property Rights
The content of our website is protected by intellectual property laws. It is forbidden to use the content of carib-gourmet.com without an authorisation from Carib Gourmet. Any reproduction or plagiarism of our content may result in civil and criminal penalties.
Our content includes: graphics, images, audio and text.
Food Hampers and Gift boxes
Our hamper and gift packages contain food items in wicker baskets or rigid cardboard containers. Some of the products in these packages are perishable items therefore your statutory right to revert the purchase within the 7 days cooling off period will not apply.
The hampers and gift boxes photographed only contain the listed items and are subject to availability. Any props used in the photography are not included in the hampers unless stated in the hamper listing.
We cannot offer gift message service with package or gift order. We apologise for the inconvenience.
With all hampers and gift packages orders, Carib Gourmet reserves the right to substitute items with an item of equal/greater value than the original, or issue a refund for the product.
Seven days cooling off period
Customers in the European Union have a right by law to withdraw from the purchase of any item within a period of seven working days starting the day following the delivery date. This right applies to all items advertised on Carib Gourmet except for:
* perishable goods and items likely to expire rapidly e.g. hampers and gift boxes containing such items
* items returned in a damaged condition
* sealed items where the seal has been broken
You may be liable for the cost of returning the item(s) to us. Refunds may take up to 14 working days.
All our prices include VAT which will be charged at the current rate. All our prices are in GBP and prices available in different currencies are for reference purposes only as local prices may change according to current currency rates. We try and ensure all details, descriptions and prices are correct. However, errors may occur. If we discover an error in the price of items you have ordered, we will contact you as soon as possible. You will have the option of either reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat your order as cancelled and will refund you. Delivery charge is an additional cost. Please report to the Delivery Information section for full details.
Carib Gourmet prices displayed on the website apply to online purchases only. They are not indicative of the price of identical items purchased by any other means. We reserve the right to update prices displayed on the website at any point.
We accept payments by credit or debit card details on our secure online order form. You can also use you Paypal account. We cannot accept cheques or cash as payment online.
Receipt of your credit card details and debit of payments does not constitute our acceptance of your order. You will need to receive an order confirmation email for your account to be charged.
Please note that we cannot guarantee the security of data when communicated via email. Accordingly please do not send us payment information using email. Unless we are fraudulent or negligent we will not be liable to you for any losses caused as a result of unauthorised access to the personal and transactional information you provide us when placing an order.
Please note we do not accept cheques as a means of payment.
To cancel your order, please contact our Customer Services on firstname.lastname@example.org. We try to process orders immediately it may not always be possible to prevent an order from being despatched. If your order has already been despatched you may return the items to us according to our Returns Policy.
Once we receive notice of your cancellation we will refund the cost of the item(s). We cannot refund delivery including standard, priority, express or courier component of the postage charge.
Standard deliveries to UK addresses are made within 5 working days. Deliveries to addresses outside the UK can take up to 14 working days. This is subject to customs inspections and delays.
Please note that multiple items orders for delivery to the same address may be despatched separately and we cannot guarantee delivery on the same day.
We make every effort to despatch items on time. If the items are not delivered in time, please contact Customer Service on email@example.com quoting the order reference.
When the items have reached the delivery address you specified when placing your order, responsibility for loss, breakage and damage passes to you. Should you specify that goods are left with a third party, this is done so at your own risk. All goods must be signed for upon delivery.
Despatch times may vary according to availability and any guarantees made as to delivery times are limited to mainland UK and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.
Deliveries outside the United Kingdom
The products specified on this website are suitable and approved for use for customers within the United Kingdom. Customers who choose to purchase items for usage and distribution to locations outside the United Kingdom do so at their own risk and have a personal responsibility regarding compliance with local laws.
For regulatory reasons, we are unable to take online orders for the delivery of fresh food and alcohol products to mainland USA.
Items for delivery outside the United Kingdom may be subject to import duties and taxes. These are levied once the items reach the specified destination. You, the customer are responsible for any import duties incurred on your own purchases.
Carib Gourmet has no prior warning on whether these charges may be incurred or what value they may be. Customs policies vary from country to country, so you should contact your local customs office for further information. Customs authorities may request personal information when inspecting your parcel; failure to provide this information to Customs will result in the parcel being returned. In this instance we are unable to refund the cost of postage and packaging.
Please note that for items you order through our website you are considered the importer and must comply with all laws and regulations of the country in which the items are to be delivered. Please note that cross-border deliveries are subject to opening and inspection by customs authorities. Carib Gourmet cannot guarantee that your goods will arrive in the same condition that they were despatched should they be subject to inspection.
Items damaged in transit
If the content of your order has been damaged in transit, we will exchange the damaged items without charge to you provided you return the damaged item(s) to us within 14 days from the delivery date.
If we have sent you an incorrect item, please notify our Customer Service as soon as possible (within 7 days), return the incorrect item to us and specify the correct details in writing. If you would like us to replace the incorrect item with the item you ordered we will send you the correct item as soon as possible or alternatively we will refund the item once it has been returned.
Please return any incorrect item to our trading address 428A Lee High Road, London SE12 8RW. We will replace or refund you for the incorrect item once we receive returned goods.
Until we receive the returned items you are responsible for their safe keeping and taking reasonable care of them. We do not accept liability for returned packages damaged during transit back to us. It is your responsibility to wrap products adequately to prevent damage.
Please note that if you are returning items from overseas, the return of items may therefore be at the senders own expense.
We will be responsible for any losses you suffer as a direct result of us breaching these online shopping Terms and Conditions if those losses were reasonably foreseeable to both you and us at the time the contract for the sale of items by us to you was formed (i.e. at the point we send the Despatch Confirmation E-mail to you).
We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions or the actions of our sub-contractors or agents, is consequential or was not reasonably foreseeable to both you and us when the contract between us was formed.
Our liability to you under these On-Line Shopping Terms and Conditions will not exceed the total price charged for the items purchased.
Events beyond our reasonable control
We will not be responsible to you for any delay or failure to comply with our obligations under these On-line Shopping Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.
